Terms of Service

Last updated: 2026-10-20

Welcome to TisTos (“TisTos”, “we”, “us”, “our”). These Terms of Service (the “Terms”) are a legal agreement between you and us that governs your access to and use of https://tistos.com/ and all related websites, tools, features, applications and APIs (together, the “Services”).

Please read these Terms carefully. By creating an account, or by accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy and Refund Policy. If you do not agree, do not use the Services.

1. Acceptance of these Terms

If you use the Services on behalf of a company, organization or other legal entity, you confirm that you have authority to bind it to these Terms, and “you” includes that entity. Additional terms may apply to specific features, plans, promotions or integrations. When they do, we will show them to you, and they form part of these Terms. If they conflict with these Terms, the additional terms prevail for that feature.

2. Eligibility and your account

  • You must be at least 16 years old (or the age of digital consent or legal majority in your country, if higher) and able to form a binding contract to use the Services.
  • You must provide accurate and complete registration information and keep it up to date.
  • You are responsible for keeping your password, API keys and other credentials secure, and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
  • One person or entity may not maintain multiple free accounts to avoid limits or evade a suspension. You may not sell, transfer or share your account without our consent, except as allowed through team features.
  • You may not use the Services if you have been suspended or banned from them, or if the law prohibits you from using them.

3. The Services

We provide an online platform with tools and features for creating, publishing and managing digital content, using artificial intelligence features, and related functionality. Features, limits and quotas depend on your plan and are described on our pricing and plan pages.

  • Free plan. The free plan is provided with limited features and quotas, may display advertising, and may be changed or withdrawn at any time. We may delete inactive free accounts and their content after a period of inactivity, after notice where practicable.
  • Beta and new features. We may offer features labeled beta, preview or experimental. They are provided as is, may change or be removed, and may not be as reliable as other features.
  • Changes. We may add, change, limit or discontinue any part of the Services. If we remove a paid feature in a way that materially reduces what you paid for, we will offer a reasonable remedy, such as a pro-rata refund of the unused period for that feature, as further described in our Refund Policy.
  • Your equipment and costs. You are responsible for your internet access, devices, and any third-party fees you incur to use the Services.

4. Plans, billing and cancellation

Paid plans

Paid plans are offered for the billing periods shown at checkout (for example monthly, quarterly, half-yearly or yearly). Prices, features and limits are shown at the time you order. At checkout you choose how you pay: One time payment or Recurring payment. The options available can depend on the plan, the billing period, your country and the payment method, and are shown at checkout.

One time payment

If you choose One time payment, you pay once for the billing period you selected, and the plan does not renew automatically. We may remind you before the period ends. To keep your paid features after that, you need to buy a plan again. When the period ends, your account moves to the free plan or closes.

Recurring payment (automatic renewal)

If you choose Recurring payment, you authorize us and our payment providers to charge your payment method automatically at the start of each billing period (every month, quarter, half-year or year, depending on the plan you selected) until you cancel. The checkout shows the price and the billing period before you pay. Each charge is made at the price in force at that time, and any change of price is handled as described below. We may send you a reminder before a renewal where the law requires. Recurring payments need a payment method that supports them, and the methods available for Recurring payment are shown at checkout.

Cancellation

You can cancel a recurring payment at any time from your account or by contacting us. Cancellation stops future charges, so cancel before your renewal date if you do not want to be charged for the next period. You keep access to paid features until the end of the period you have already paid for, after which your account moves to the free plan or closes. A one-time payment does not renew, so there is nothing to cancel and the plan simply ends at the end of the period.

Payment, taxes and failed payments

  • You agree to pay all fees and applicable taxes (such as VAT or GST). Prices may be shown with or without taxes depending on your location.
  • You must provide valid payment details. If a payment fails (for example a recurring payment is declined), we may retry it, suspend paid features, or downgrade your account after reasonable notice.
  • You are responsible for any bank, currency-conversion or gateway fees charged by your payment provider.

Price changes

We may change prices or plans. A change does not affect a period you have already paid for. For a recurring payment, a change takes effect at your next renewal, and we will tell you in advance (generally at least 30 days) so you can cancel before it applies. For a one-time payment, the new price applies to your next purchase.

Refunds

Refunds of fees paid to us are governed by our Refund Policy, which forms part of these Terms. Refunds of purchases made by your own customers are your responsibility, as explained in the Accepting payments from your customers section.

Downgrades and limits

If your plan changes or ends, content or settings that exceed the limits of your new plan may become unavailable, be disabled or be deleted after notice. Please export or back up what you need before changing your plan.

Nothing in these Terms limits any statutory right you may have as a consumer, including any right to cancel or withdraw that cannot be waived in your country.

5. Your content and the license you give us

  • You own your content. You keep all rights in the text, images, files, links, data and other material you create, upload or publish through the Services, together with your AI inputs and the outputs generated for you (“Your Content”). We do not claim ownership of it.
  • License to us. You give us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, display, transmit and distribute Your Content only as necessary to provide, secure, support and improve the Services, to enforce these Terms, and to comply with law. For content you make public, this includes showing it to anyone who can access it. The license lasts while Your Content is on the Services and for a reasonable period afterward for backups and legal purposes.
  • Your responsibility. You are solely responsible for Your Content and for having all rights, licenses, consents and permissions needed to upload and use it, including from the people shown in or identified by it. You are responsible for the way you share it and for the consequences of making it public.
  • Backups. We take reasonable steps to protect your data, but we do not guarantee that it will never be lost. Keep your own copies of anything important.
  • Feedback. If you send us ideas or suggestions, we may use them without obligation to you.
  • Stored files. We may limit the file types, sizes and total storage available, and may refuse or remove files that exceed those limits, are unsafe or are not permitted. We may also apply fair-use limits to storage bandwidth and traffic.

6. Acceptable use

You agree to use the Services lawfully, responsibly and respectfully. You must not use the Services, Your Content, links, pages, QR codes, domains, stored files, AI features or API, or allow anyone else to use them, to:

  • break any law or regulation, or infringe or violate the rights of others, including copyright, trademarks, privacy, publicity and other rights;
  • create, store, share or link to content that is illegal, or that sexually exploits or endangers minors, promotes terrorism or violent extremism, incites violence or hatred against people or groups, harasses, threatens, defames or doxxes others, or promotes self-harm;
  • publish adult or sexually explicit content, graphic violence or gore, where this is prohibited by law or by the policies of our advertising and payment partners, or where we decide it is not suitable for the Services;
  • distribute malware, run phishing, scams, fraud, pyramid or other deceptive schemes, or point links or QR codes to malicious, deceptive or illegal destinations;
  • send spam or unsolicited bulk messages, or collect personal data in a deceptive or unlawful way, including scraping or harvesting user information;
  • impersonate any person or organization, misrepresent your identity or affiliation, or create deceptive content, including deceptive synthetic media;
  • offer or promote illegal or restricted goods and services, such as counterfeit goods, illegal drugs, weapons, stolen data or items, unlicensed gambling or regulated financial services without proper authorization;
  • interfere with, overload or disrupt the Services or networks, bypass limits, quotas, rate limits, paywalls or security measures, or probe, scan or test the vulnerability of the Services without permission;
  • access the Services by automated means (such as bots or scrapers) except through the API as allowed in these Terms;
  • copy, modify, reverse engineer, decompile or create derivative works of the Services, except where the law allows it despite this restriction;
  • resell, sublicense or provide the Services to third parties as a competing service, except where we expressly allow it, such as through white-label features;
  • use the Services to build or train a competing product or service, or to develop AI models, without our written permission;
  • publish content or engage in activity that violates the policies of our advertising, payment, AI, hosting or other service partners that apply to the Services;
  • generate invalid traffic, or click on, or encourage others to click on, advertisements shown on the Services in order to manipulate or inflate them.

We may review, restrict, disable or remove any content, link, page, domain, account or feature that we reasonably believe violates these Terms or the law, or that creates risk for us, our users or our partners. We are not obliged to monitor content, but we may use automated and human review, including checking link and file destinations for malware, phishing and other abuse, to enforce these Terms.

7. AI features

The Services include artificial intelligence features, such as generating text, images, and audio, and converting speech and text. They are supported in part by third-party AI model providers. By using them you agree to the following:

  • Your inputs and outputs. Between you and us, you own your inputs, and, to the extent the law allows, you own the outputs generated for you. Outputs may not be unique and may be similar to outputs given to others. We do not guarantee that outputs are original, accurate, complete, lawful or free from third-party rights.
  • Review before use. Outputs can be wrong or misleading. Do not rely on them as professional, legal, medical, financial or safety advice, and do not use them for decisions that have legal or similarly significant effects on a person. You are responsible for reviewing outputs and for how you use them.
  • Permitted use. You must have the rights and any required consents for the inputs you provide, including images, voices and personal data of other people. You must not use the AI features to create content that is prohibited under Acceptable use, to imitate a real person’s voice or likeness without their consent, to create deceptive or harmful synthetic media, to identify individuals from their face or voice, or for any purpose prohibited by the usage policies of our AI providers.
  • Transparency. Where the law requires it, you must clearly disclose that content is AI-generated or synthetic, and you must not remove technical markers we or our providers add to outputs.
  • Provider terms. AI features are delivered through third-party providers whose own terms and usage policies also apply, and we may change providers or models at any time. Your inputs are processed as described in our Privacy Policy.
  • Limits. AI features may be subject to usage limits, credits or fair-use rules that depend on your plan. We may refuse or block requests that violate these Terms or our providers’ policies.

8. Accepting payments from your customers

The Services let you connect your own account with supported third-party payment gateways so your customers can pay you, and so that funds are paid directly to your gateway account. If you use these features:

  • You are the seller. Every sale is a contract between you and your customer. We are not a party to it, not your agent, and not a seller, marketplace, bank, payment institution or money transmitter. We do not receive, hold or transfer your customers’ funds, and we are not responsible for the goods, services, content, prices, delivery or quality you offer.
  • Gateway terms apply. To use a gateway you must have an account with it and accept its terms. The gateway (not us) processes payments, verifies your identity and business, applies its own fees, limits, holds, payout schedules and risk checks, and handles chargebacks and disputes with you. We are not responsible for the gateway’s decisions, delays, outages or errors.
  • Eligibility and compliance. You must be legally able to sell what you offer, and you are responsible for complying with all laws that apply to you, including consumer protection, distance selling, advertising, licensing, product safety, sanctions, anti-money-laundering and tax laws.
  • Pricing, taxes and invoices. You set your prices and are responsible for calculating, collecting and reporting all taxes, and for issuing invoices and receipts that the law requires.
  • Terms for your customers. You must give your customers clear information about what they are buying, your prices, delivery, cancellation, return and refund policy, your contact details, and a privacy notice. You are responsible for refunds, returns, support and resolving complaints. Our Refund Policy applies only to fees you pay to us, not to what your customers pay you.
  • Prohibited sales. You must not use the payment features to sell or collect payments for anything prohibited under Acceptable use, anything prohibited by the gateway or by card networks, or for fraudulent, deceptive or unlawful purposes. You must not use the Services to collect card numbers or passwords yourself.
  • Credentials. You are responsible for the API keys and credentials you connect. Use keys with the minimum permissions needed, and revoke them if they are exposed.
  • Our right to act. We may disable the payment features, remove content or suspend your account if we suspect fraud, abuse, legal risk, a violation of these Terms or of a gateway’s rules, or if a gateway or authority asks us to.
  • No guarantee. We do not guarantee that payments will be successful, that a gateway will remain available, or that you will receive any particular amount. We are not liable for lost sales, chargebacks, refunds, fines, frozen or withheld funds, or disputes between you and your customers or your gateway.
  • Fees. Any fees we charge for payment-related features are shown in your plan. Fees charged by gateways are separate and are set by them.

9. Teams

  • A team workspace is controlled by its owner and administrators, who can invite and remove members, assign roles and permissions, manage billing, and view, manage, export or delete workspace content and activity.
  • The owner is responsible for the members they invite, for making sure each member follows these Terms, and for informing members how their data is handled. Members must follow these Terms and the owner’s reasonable rules.
  • As between you and us, content created in a workspace is controlled by the workspace owner and remains available to the owner when a member leaves. Rights between the owner and the members are a matter between them.
  • Seats, member limits and fees depend on the plan. If you are invited by an organization to its workspace, that organization, not us, decides how you may use it and what happens to your content in it.
  • If the owner’s account is suspended, closed or downgraded, workspace access and content may be limited or removed for all members.
  • If you use a workspace or account provided by your employer or school, they may be able to access or control it. Do not use it for personal matters you want to keep private.

10. API access

If your plan includes API access, we grant you a limited, revocable, non-exclusive, non-transferable right to use the API according to our documentation and these Terms, to build your own integrations and applications.

  • Keys. Keep API keys secret, do not share them or embed them in public code, and revoke a key immediately if it is exposed. You are responsible for all activity done with your keys.
  • Limits. The API is subject to rate limits, quotas and other technical limits shown in the documentation or your plan. You must not circumvent them or create multiple accounts or keys to evade them.
  • Your applications. You are responsible for your applications and their users, including their legal compliance, security, terms and privacy notices. You must not suggest that we sponsor or endorse your application.
  • Permitted use. Your use of the API is subject to Acceptable use and to any additional rules in the documentation. You must not use the API to build a competing service, to extract data in bulk beyond your own content, or to train AI models.
  • Changes and deprecation. We may update, version, limit or discontinue API features. For material breaking changes we will give reasonable advance notice where practicable.
  • Data protection. If you process personal data of other people through the API, you must have a lawful basis for doing so, and the roles of the parties are described in our Privacy Policy.
  • Suspension. We may suspend or revoke keys for security, abuse or violations of these Terms. The API is provided as is and may be unavailable or change at any time.

11. Custom domains

If your plan allows you to connect your own domain to the Services:

  • You must own the domain or have the right to use it, and you must not connect domains that infringe the rights of others or that are used for illegal or deceptive purposes.
  • You are responsible for the domain registration, renewal, DNS settings and any fees charged by your registrar or DNS provider. We are not responsible for loss of a domain, DNS errors, propagation delays, or outages caused by your settings or your providers.
  • We may issue and renew security certificates for the domain automatically. You must keep the required DNS records in place for this to work, and remove them when you stop using the domain with the Services, to avoid misuse of your domain.
  • You are responsible for the cookie, consent and legal notices required for visitors to your domain.
  • We may disconnect a domain, or restrict its content, if it violates these Terms or if required by law. If your plan ends, the domain connection may stop working.
  • Connecting a domain gives you no ownership of any TisTos brand, name or address.

12. White labeling

If your plan includes white-label features, you may present parts of the Services under your own brand, for example by hiding or replacing our name, logo and similar branding where the feature allows it. If you do:

  • Your relationship with your users. You are responsible for your users and customers, including support, billing, content, and compliance with the law. You must provide them with your own terms of service and privacy notice, which must identify you, not us, as the party they contract with and that is responsible for their data. Those terms must be at least as protective of us as these Terms.
  • Honesty. You must not misrepresent your service or its features, and must not claim that you own the Services or their underlying technology. Where the law requires us or our providers to be named, you must keep that information visible.
  • Your content and branding. You confirm you have the rights to the names, logos, and other branding you upload, and they must not infringe or mislead.
  • Responsibility. You are responsible for the acts and omissions of your users and customers in the Services, and for ensuring they comply with Acceptable use. A breach by them may be treated as your breach.
  • No transfer of rights. White labeling does not transfer any ownership of the Services or our intellectual property to you, and does not allow you to resell the Services as a stand-alone product unless we agree in writing.
  • Ending. If your plan ends or white labeling is withdrawn, our standard branding may be restored.

13. Advertising on the Services

The Services, particularly the free plan, may show advertising, including advertising provided by third parties. We do not control and are not responsible for third-party ads or the products they promote, and your dealings with advertisers are solely between you and them. We may place ads on, next to or around pages and content you publish through the Services, subject to your plan. You do not receive payment for ads we show unless we agree in writing. Our Privacy Policy and Cookie Policy explain how advertising works and your choices.

14. Third-party services and links

The Services may integrate with or link to third-party services such as payment gateways, AI providers, sign-in providers, domain registrars and other websites. These are provided by third parties under their own terms and privacy policies, which you must follow. We do not control them and are not responsible for them, their content or their availability. Your use of them is at your own risk.

15. Our intellectual property

The Services, including software, design, text, graphics, trademarks, logos and all related intellectual property, belong to us or our licensors, excluding Your Content. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for their intended purposes. We reserve all rights not expressly granted. You may not use our name, logo or trademarks without our written permission, except as allowed through white-label features or as needed to accurately refer to the Services.

16. Reporting illegal content and copyright

Reporting content

If you believe content on the Services is illegal or violates these Terms, report it to [email protected] with the exact address (URL) of the content, an explanation of why you consider it unlawful or in breach, and your contact details. We review reports and act where appropriate, and we may tell the content owner about the report.

Copyright complaints

If you believe content infringes your copyright, send a notice to [email protected] containing: identification of the work; the address of the infringing material; your name and contact details; a statement that you have a good-faith belief that the use is not authorized by the owner, its agent or the law; and a statement, under penalty of perjury where applicable, that the information is accurate and that you are the owner or authorized to act for the owner. We may remove or disable access to the content, and notify the user who posted it. A user may submit a counter-notice if they believe the content was removed by mistake. We may terminate the accounts of repeat infringers.

Knowingly submitting a false report may have legal consequences.

17. Privacy and data protection

Our Privacy Policy explains how we handle personal data. Where you use the Services to process personal data of other people (for example your visitors, customers, team members or API users), you are responsible for doing so lawfully, and our Privacy Policy describes our role as your service provider. Where required, we can enter into a data processing agreement with you on request.

18. Availability, changes and support

We work to keep the Services available, but we do not promise uninterrupted or error-free operation. The Services may be unavailable because of maintenance, updates, failures of third-party providers, security incidents or events beyond our control. We may provide support in the ways and during the times described for your plan, and we are not obliged to provide support beyond that.

19. Suspension and termination

  • By you. You may stop using the Services and delete your account at any time through your account or by contacting us. Deleting your account does not by itself entitle you to a refund, except as stated in our Refund Policy or required by law.
  • By us. We may suspend, restrict or terminate your access, or remove content, immediately and without prior notice if we reasonably believe you have violated these Terms or the law, if your use creates risk or harm for us, other users or third parties, if you do not pay, if we are required to by law or by a partner such as a payment gateway or advertising provider, or if you are inactive on the free plan. Where practicable and lawful, we will tell you why and give you a chance to fix the problem.
  • Reasons and appeals. When we restrict or remove content, or suspend or terminate an account, we will, where the law requires (for example under the EU Digital Services Act) and where it is safe and lawful to do so, tell you what we did, why, and how to appeal. You can appeal by replying to our notice or by writing to [email protected], and we will review your appeal and respond within a reasonable time.
  • Discontinuation. We may discontinue the Services or parts of them. If we discontinue a paid service, we will give reasonable notice and a pro-rata refund of the unused prepaid period, as described in our Refund Policy.
  • Effect. On termination your right to use the Services ends, and we may delete Your Content after a reasonable period, subject to our legal obligations and our Privacy Policy. Please export what you need beforehand. Sections which by their nature should continue (including those on content, intellectual property, payments owed, disclaimers, liability, indemnification and governing law) survive.

20. Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. We do not warrant that the Services, AI outputs, third-party services or advertising will be accurate, reliable, secure, available or suitable for your needs, or that defects will be corrected. You use the Services at your own risk.

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you. Nothing in these Terms limits warranties or rights that cannot be excluded under the law that applies to you.

21. Limitation of liability

To the maximum extent permitted by law:

  • we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, sales, business, goodwill, data or opportunities, arising out of or related to the Services or these Terms, even if we were told they were possible;
  • our total liability for all claims arising out of or related to the Services or these Terms will not exceed the greater of (a) the amount you paid us for the Services in the 12 months before the event giving rise to the claim, and (b) USD 100;
  • we are not liable for the acts or omissions of third parties, including payment gateways, AI providers, advertisers, domain providers, and your own customers and users.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or intentional misconduct. The limits above apply regardless of the legal theory, including contract, tort (including negligence) and strict liability.

22. Indemnification

To the extent permitted by law, you will defend, indemnify and hold harmless us, our affiliates, and our and their officers, directors, employees and agents from and against any claims, damages, losses, liabilities, fines, costs and expenses (including reasonable legal fees) arising out of or related to: Your Content; your sales and your dealings with your customers; your use of the Services in breach of these Terms or the law; your applications and users; your domains and branding; or your violation of the rights of any third party. We will notify you of the claim, and you will not settle a claim in a way that imposes obligations on us without our consent. This section does not apply to consumers where the law does not allow it.

23. Compliance, sanctions and export controls

You must comply with all laws that apply to your use of the Services, including export control, trade sanctions, anti-bribery and anti-money-laundering laws. You confirm that you are not located in, or ordinarily resident in, a country or territory subject to comprehensive sanctions, and that you are not on any restricted-party list. We may restrict access to the Services in any country or to any user where required by law.

24. Governing law and disputes

These Terms and any dispute arising out of or in connection with them are governed by the laws of Vietnam, excluding its conflict-of-law rules, and the competent courts of Vietnam have jurisdiction, subject to any mandatory consumer rights that apply to you.

Before starting a formal dispute, we encourage you to contact us at [email protected] so that we can try to resolve it informally. If you are a consumer, you may also have the right to bring a claim in the courts of your country of residence and to rely on the mandatory consumer protection laws of your country, and nothing in these Terms removes those rights. Where available, you may also use an online dispute resolution platform provided by the authorities of your region.

25. Changes to these Terms

We may update these Terms from time to time, for example to reflect new features, changes to the law or business changes. If we make material changes, we will notify you by email, in-app notice or a prominent notice on the Services, generally at least 30 days before they take effect, unless a shorter period is required for legal or security reasons. The “Last updated” date shows the latest version. If you do not agree to the updated Terms, you must stop using the Services and may cancel your plan before they take effect. Continued use after the effective date means you accept the updated Terms.

26. General provisions

  • Entire agreement. These Terms, together with our Privacy Policy, our Refund Policy and any additional terms we present to you, are the entire agreement between you and us about the Services, and replace earlier agreements about them.
  • Severability. If a provision of these Terms is found to be invalid or unenforceable, it will be limited or removed to the minimum extent needed, and the rest remains in effect.
  • No waiver. If we do not enforce a right, it is not a waiver of it.
  • Assignment. You may not assign or transfer these Terms without our written consent. We may assign them, for example in connection with a merger, acquisition or sale of assets, or to an affiliate.
  • Force majeure. We are not liable for failure or delay caused by events beyond our reasonable control, such as natural disasters, war, labor disputes, power or network failures, government action, or failures of third-party providers.
  • Notices. We may send notices to the email address in your account or by posting them on the Services. You may contact us at the email addresses in the Contact us section.
  • Language. These Terms may be provided in several languages for convenience. If there is any inconsistency, the English version prevails to the extent permitted by law.
  • No third-party beneficiaries. These Terms do not give rights to anyone who is not a party to them, except as stated in them.
  • Relationship. You and we are independent parties. Nothing in these Terms creates a partnership, employment or agency relationship.
